Greetings from TinyFam. According to the Information Technology Act of 2000, this document is an electronic record and was published in accordance with Rule 3 of the Information Technology (Intermediaries guidelines) Rules of 2011, which mandates the publication of the terms and conditions, privacy statement, and rules for accessing or using the TinyFam Marketplace Platform (www.tinyfam.com) (hereinafter referred to as "Platform")

 

The Platform is owned by TinyFam Private Limited, which has its registered office at Unit No. 203, 2nd Floor Suite No.234, SBR CV Towers, Sector-1, Sy No 64, HUDA Techno Enclave, Madhapur, Hyderabad - 500081.

The following terms and conditions ("Terms of Use") which apply to TinyFam, including the applicable policies that are incorporated herein by reference, govern your use of the website, its services, and features. You will enter into a contract with TinyFam Private Limited, the platform's owner, just by using TinyFam. Your legal duties to TinyFam are governed by these terms and conditions and the policies.

Wherever the context so requires, "You" or "User" shall refer to any natural or legal person who has consented to become a buyer on the Platform by giving information during registration as a Registered User on the Platform. TinyFam Private Limited and its affiliates are referred to as "TinyFam," "We," "Us," and "Our."

The rules, guidelines, policies, terms, and conditions that apply to each service will be deemed to be incorporated into and considered a part of this Terms of Use when You use any of the services offered by Us through the Platform, including but not limited to (e.g., Product Reviews, Seller Reviews). We hold the right to alter, amend, add, or remove any part of these Terms of Use at any time without giving You prior written notice. You must make sure to periodically review these Terms of Use for updates/changes. You will be deemed to have accepted and agreed to the changes if you continue to use the Platform after they have been posted. We give You a limited, non-exclusive, personal right to access and use the Platform as long as You abide by these Terms of Use. You agree to be bound by TinyFam Policies, including but not limited to the Privacy Policy as changed from time to time.

1. User Account, Security, and Password:

You are in charge of protecting the privacy of your Display Name and Password if you use the Platform, and you are also accountable for any actions taken using those details. You acknowledge that We shall have the right to permanently suspend, terminate, or restrict access to your membership on the Platform if You supply any information that is untrue, inaccurate, out of date, or incomplete.

You consent to:

• Any unauthorised use or breach of your password or account must be reported right away to TinyFam.
• Make sure to log out of your account after each session.

2. Services Provided

The Website is an online platform that offers internet-based services. It does the following:

• Offers a platform for Users (who are sellers) to advertise, exhibit, make available, and offer to sell different Products to other Users (who are buyers / customers).
• Provides services to facilitate the engagement of buyers and sellers to engage in commerce on the Website.
• The Users (who are buyers / customers) can access the Services through a variety of modes, including the distribution of coupons and vouchers that can be redeemed for a range of Products.

We have the right to deny service to anybody at any time for any reason. You acknowledge that your content (except credit card/debit card information) may be transported unencrypted and include (a) transmissions over multiple networks and (b) conformance and adaptation to the technical requirements of connecting networks or devices. Credit card/Debit card information is transmitted over networks using encryption.

 3. Eligibility of Use:

Minors under the age of eighteen (18) and Users who have been suspended or removed from the TinyFam system by TinyFam for any reason whatsoever are not eligible to use the Services. You won't be able to use the Website or the Services if you are disqualified as stated in the sentence before. You certify that You are of legal age to enter into contracts and that You are not otherwise ineligible to use the Services under Indian law. Despite the aforementioned, if You Are Under the Age of Eighteen (18), Please Read Through These Terms of Use With Your Parent Or Legal Guardian. In such a case, These Terms of Use Shall Be Considered A Contract Between TinyFam And Your Parent Or Legal Guardian And Shall Be Enforceable Against You To The Fullest Extent Permitted By Applicable Laws.

3.1. Account, password and security:
You can view and use the website and services as a registered user and guest user. But not all features of the website and services will be open to guest users.

3.2. Registered users:
TinyFam will make some sections of the services accessible to you through the website only if you have provided TinyFam with the required user information and created an account and TinyFam ID using a specific login ID and password ("Account. You can create Your Account on the Website by logging in with Your third-party website user ID and password, such as those from Meta Platforms, Inc., Google LLC or its subsidiaries, Twitter, Inc., LinkedIn Corporation, Microsoft Corporation, Snap Inc., or any other social media website, or any other Internet service allowed on the Website (TinyFam ID and/or other third-party login identification as provided above are individually and collectively referred to as the "Account Information".)

You will be in charge of protecting the privacy and security of the Account Information if you register as a User and create an Account to use the Services offered by the Website. You will also be entirely responsible for all activities that take place under Your Account. You acknowledge and undertake to: (a) promptly alert TinyFam about any unauthorised use of Your Account Information or any other security breach; and (b) take all necessary steps to ensure that You leave from Your Account at the conclusion of each session. If You do not abide by this part, TinyFam cannot and will not be held responsible for any loss or damage that results. Due to Your failure to maintain Your Account Information private and confidential, TinyFam or any other user of or visitor to the Website may suffer losses as a result of permitted or unauthorised use of Your Account.

You are responsible for making sure the Account Information you enter into the website's registration form is correct, complete, and up-to-date. It is completely forbidden to use another user's account information to access the Services.

TinyFam reserves the right to suspend or terminate Your Account and refuse any and all current or future use of the Website / Services if You provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or TinyFam has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete (or any portion thereof).

Guest users: Unregistered Users (also known as "guest users") are given limited access to the Services through the Website. These users will have access to the Website and the Services, allowing them to explore, shop. You will not, however, be given access to place orders and several benefits that are only available to registered users. These advantages could alter occasionally.

You could be required to supply certain personal information, and TinyFam might collect certain personal information, depending on whether You are a seller, a buyer, or another user who wishes to use the Website in another capacity. Please go through TinyFam privacy policy to see how you provide personal information and how TinyFam collects, stores, uses, discloses, and otherwise deals with that personal information ("Privacy Policy").

4. User Guidelines and the Platform:

4.1. TinyFam grants You a non-exclusive, non-sub-licensable, non-transferable, revocable, and limited licence to access and use this Website and the Services made available thereon, subject to your compliance with the Agreement(s).

4.2. You acknowledge that you may only use the Services, Website, and Content (as defined here) in accordance with the Agreement(s), which includes these Terms of Use and any applicable laws.

4.3. You hereby agree that you will not access (or attempt to access) the Website or Services by any channel other than those that are made available by TinyFam.

4.4. You may not access, acquire, copy, or monitor any portion of the Website or Content (as defined below) through the use of any deep links, robots, or other automatic devices, programmes, algorithms, or methodologies, nor may you in any way duplicate or interfere with the Website's navigational structure or presentation in order to obtain or attempt to obtain any materials, documents, or information through any means not intentionally made available through the Website.

4.5. If you think any Content, User Content (as defined below), or other content on the Website violates the terms of the Agreement(s) or the law, you can report it through email at support@tinyfam.com.

4.6. You may be able to post content, data, or information of your own on the Website. For example, you may be able to rate products, sellers, and post comments and reviews related to products on particular pages of the website. You may also use the website or services to send TinyFam any suggestions, comments, questions, or other information (collectively referred to "User Content"). The User Content that you upload, post, publish, transmit, or otherwise make available on the Website is your responsibility because you created it. To publish any User Content, you warrant that you have secured all necessary permissions and approvals. Furthermore, you guarantee that all such User Content will abide by all relevant legal requirements. You agree that TinyFam is not responsible or accountable for any User Content and does not support any User Content on the Website.

4.7. You hereby grant TinyFam a non-exclusive, perpetual, worldwide, royalty-free right and licence to use, copy, distribute, display, publish, transmit, make accessible, reproduce, modify, adapt, and create derivative works of the User Content. You affirm and warrant that, as of the date on which the User Content was posted or submitted on the Website: (i) the User Content is accurate; (ii) use of the User Content you supply does not violate these Terms of Use; and (iii) the User Content is lawful. You represent and warrant that you own or otherwise control all of the rights to the User Content that You post or that You otherwise provide on or through the Website.

4.8. You agree, understand, and acknowledge that the Website is an electronic platform in the shape of an electronic commerce marketplace and an intermediary that offers an electronic setting where different Users may electronically communicate and meet in order to conduct business. The Products are not sold by TinyFam. Therefore, any agreement for the sale or purchase of Products on the Website is a joint agreement between You and the seller (if You are a buyer) or between You and the buyer (if You are a seller).

4.9. You expressly agree not to host, display, upload, change, publish, transmit, update, or share any material or content on the Website or through the Services that:

4.10. You understand that if You break any of Your obligations under these Terms of Use or other Agreements, TinyFam, its affiliates, or its vendors may suffer loss or harm as a result, which is entirely Your own responsibility.

4.11. User Content is not pre-screened by TinyFam. TinyFam regrets deeply that it does not monitor user-generated content. However, if TinyFam deems in its sole judgement that any User Content is in violation of these Terms of Use or any applicable legislation, TinyFam may, at its discretion and/or in accordance with applicable law, monitor any User Content and may delete any User Content from the Website. When TinyFam takes down any User Content from the Website, it will make a reasonable effort to contact the user who originally posted it. Such measures in no way undermine or lessen TinyFam's role as a middleman or subject TinyFam to any obligation with regard to User Content.

4.12. You must use this website, together with any vouchers or coupons you purchase through it, strictly for your own personal, non-commercial use; you may not sell them to anyone else.

5. Billing and Account Information

Any order you place with us may be rejected by us at our own discretion. We have the right to place restrictions on the total quantity that can be purchased by a single customer, an entire household, or an individual order. Orders that are placed by or under the same customer account, the same payment card, and/or orders that use the same billing and/or delivery address may be subject to these restrictions. In the event that we must make a modification to an order or cancel it entirely, we will make every effort to get in touch with you by using the e-mail address and/or billing address and/or phone number that you gave us at the time the transaction was placed. We will not accept orders that, in our sole discretion, appear to be placed by dealers, resellers, or distributors, and we reserve the right to limit or prohibit such orders.

By shopping on TinyFam, you consent to provide account information that is up to date, complete, and correct for each and every transaction. You acknowledge that it is your responsibility to immediately update your account and other information, including your email address, credit card numbers, and expiration dates, in order for us to successfully complete your transactions and get in touch with you as required.

6. Platform Contents Posted:

All text, images, user interfaces, visual interfaces, pictures, trademarks, logos, sounds, music, and artwork (collectively, "Content") are third party user contributed content. You hereby grant Us the transferable rights in and to such Content, which shall become Our property. We shall have the right to use the Content or any of its components in accordance with Our Privacy Policy, as adopted in compliance with applicable law, for any purpose, including but not limited to promotional and advertising purposes and in any media, whether now known or hereafter developed, including the creation of derivative works that may contain the Content You provide.

TinyFam is not responsible for any errors, exclusions, or content which is not current on the website. The information on www.tinyfam.com is general, and you should not make decisions based only on this information without considering accurate and detailed sources of information. You agree to use this website's content at your own risk.

This website may have content which can be historical information. Historical Information refers to any piece of information which is out dated. TinyFam reserves the right to edit the changes on the website at any time.

You may utilise the product and service information that has been specifically made available for download on the platform, provided that You Do not modify any copies of such documents to remove any proprietary notice text.

Use such information exclusively for personal, non-commercial informational purposes; do not copy, post, or otherwise distribute it over any networked computer or other kind of electronic broadcast;

If we make any modifications, product price change, suspensions, or discontinuance of the Service, we shall not be in any way be liable to you or any third-party.

9. Typographical Errors

If a product is posted at an incorrect price or with incorrect information due to a typographical error, we have the right to refuse or cancel any orders placed for that product. We reserve the right to refuse or cancel any such order, whether or not it has been confirmed and your card has been charged. If your card has already been billed for the purchase and your order is cancelled, we will send a refund to your account or other payment account as soon as possible.

TinyFam gives you access to this site "as is" and "as available." TinyFam doesn't make any promises or warranties, either express or implied, about how this site works or about the information, content, materials, or products on it. You clearly agree that you use this site at your own risk and no one else's. TinyFam has the right to remove or change any information on this site whenever it wants.

TinyFam doesn't honour any warranties, whether they are written or implied. TinyFam does not promise that this site, its servers, or emails sent from TinyFam are free of viruses or other harmful things. TinyFam won't be responsible for any kind of damage that comes from using this site, including direct, indirect, incidental (small) , and consequential (major) damages.

11. Selling:

In line with the Policies, which are incorporated by reference in these Terms of Use, you are permitted to put item(s) for sale on the Platform as a registered seller. The item(s) you put for sale on the Platform must be able to be sold legally by you. You must make sure that none of the things on the list violate anybody else's intellectual property rights, trade secrets, other proprietary rights, or rights of publicity or privacy. Only text descriptions of your goods for sale, graphics, and images are permitted in listings. For successful order fulfilment, all stated items must be kept in stock. The item's listing description must accurately reflect the item's condition and not be deceptive. You undertake to return any payments you may have received from the Buyer if the item description does not reflect the actual condition of the item. TinyFam retains the right to remove any additional listings you make for the same product in other categories.

When you browse the website (www.tinyfam.com) or send us emails, we communicate with you electronically. You consent to receiving electronic communication from us. We will communicate with you through e-mail. You agree that any communication from us (TinyFam) to you, including all agreements, notices, disclosures, and other communications, is done electronically and satisfy with all applicable legal requirements for written communications.

13. Indemnity:

You agree to defend and hold TinyFam, its owner, licensee, affiliates, subsidiaries, group companies (as applicable), and each of their officers, directors, agents, and employees harmless from any claim or demand made by a third party or penalty imposed as a result of or arising from Your violation of this Terms of Use, privacy policy, and other Policies, or Your violation of any law, rule, or regulation, or the rights (including intellectual property rights) of another person.

14. Severability

Any provision of these Terms of Service that is found to be unlawful, void, or unenforceable shall still be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, without invalidating or affecting the validity or enforceability of any other provision of these Terms of Service.
